I. PREAMBLE AND RECITAL OF INTENT

WHEREAS, the Entity is engaged in the dissemination, commercialization, and logistical distribution of herbal preparations, powders, and associated consumable goods (hereinafter “Merchandise”); and
WHEREAS, the Individual, Visitor, Consumer, or Entity (hereinafter referred to as the “User,” “Data Subject,” “You,” or “Your”) accessing said Platform desires to utilize the services therein;
NOW, THEREFORE, in consonance with the provisions of the Information Technology Act, 2000, and Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, this Privacy Policy is hereby formulated to delineate, obfuscate, and expound upon the methodologies regarding the collection, retention, and dissemination of your data.
II. ACKNOWLEDGEMENT AND IRREVOCABLE CONSENT
By the mere act of navigating, browsing, scrolling, or otherwise interfacing with the Platform, specifically including but not limited to the initiating of purchase requisitions for herbal compounds, the User is deemed to have acknowledged, understood, and unequivocally agreed to be bound by the intricate stipulations contained herein.

The Entity reserves the unmitigated right to harvest, archive, and process information in a manner including, but not limited to, the following classifications:
A. Personally Identifiable Information (PII): In the eventuality that the User elects to engage in a transactional relationship with the Entity, the Entity shall necessitate the disclosure of specific nomenclature (Name), electronic mail identification strings (Email Address), telephonic contact integers (Mobile Number), and geographical coordinates for logistical fulfillment (Shipping/Billing Address).
B. Non-Personal and Technical Metadata: The Entity’s servers may, through automated algorithmic processes, accumulate data incidental to your access, including but not limited to the Internet Protocol (IP) address, the nature and version of the browser software utilized, the operating system architecture, and the timestamp of access (“Traffic Data”). This data is aggregated to facilitate statistical analysis and is generally not utilized to specifically identify the User, except wherein required by statutory compulsion.
IV. UTILIZATION AND DEPLOYMENT OF COLLECTED INTELLIGENCE
The information so garnered by the Entity shall not be utilized for purposes extraneous to the operational efficacy of the business, except as detailed below:
Transactional Fulfillment: To execute, facilitate, and bring to fruition the commercial exchange of currency for Merchandise, specifically the dispatching of herbal products from the manufacturing unit located at Everfit Healthcare/Blue Mountain facilities to the User’s designated locus.
Communication Protocols: To transmit administrative notices, fiscal invoices, and pertinent updates regarding the status of the User’s requisitions.
Jurisdictional Compliance: To adhere to, satisfy, and comply with any judicial, quasi-judicial, or governmental decrees, inclusive of tax liabilities and statutory reporting as mandated by the laws of the Republic of India.
V. DISCLOSURE TO EXTRANEOUS THIRD PARTIES AND INTERMEDIARIES
The User accepts that while the Entity endeavors to maintain confidentiality, absolute sequestration of data is an impossibility in the digital epoch. Therefore, the Entity may share, transfer, or disclose said data to:
Logistical Partners: External entities contracted for the physical conveyance of the Merchandise. The User acknowledges that the sharing of address and contact details with such couriers is a prerequisite for delivery.
Fiscal Processors: Third-party payment gateways utilized for the processing of monetary transactions. The Entity explicitly disclaims liability for the retention of sensitive financial data (credit card numerics, banking passwords) by such third parties, as the Entity does not archive such data on its own servers.
Affiliated Entities: The manufacturing arm, Everfit Healthcare, or other subsidiary divisions, strictly for the purpose of inventory management and product consistency.

VI. INDEMNIFICATION REGARDING PRODUCT REPRESENTATION
While referencing the data related to product preferences, the User acknowledges that the Entity’s descriptions of Merchandise are accurate to the extent of ingredients utilized. The User explicitly understands that terms denoting absolute purity (e.g., “100%,” “Pure”) are utilized in a colloquial marketing sense and that the Merchandise may contain necessary excipients, preservatives, or chemical additives required for stabilization, shelf-life, or consistency, effectively nullifying any assumption of an exclusively raw biological composition.
VII. JURISDICTION AND DISPUTE RESOLUTION
Any dispute, controversy, or claim arising out of or relating to this Policy, or the breach, termination, or invalidity thereof, shall be settled by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat of the arbitration shall be Indore, Madhya Pradesh.
Notwithstanding the foregoing, the courts at Indore shall have exclusive jurisdiction over any matters arising out of or relating to this Policy, to the exclusion of all other courts that might otherwise have jurisdiction.
VIII. GRIEVANCE REDRESSAL MECHANISM
